TERMS AND CONDITIONS FOR USING BLUAQUA
Bluaqua.co.ke is a website owned and operated in Nairobi.
The terms and conditions apply to all orders placed on this site or on live chat (WhatsApp, Instagram Direct, Messenger, and Phone Call). Please read these Terms and Conditions carefully before proceeding. By placing an order on the BluAqua.co.ke website or when ordering through our customer services team, you are agreeing to our terms and conditions.
Ingredients
All soaps may contain or come into contact with other allergens.
It is the Customer’s responsibility to notify us of any allergies prior to the confirmation of their booking. The Customer is responsible for informing their guests of any allergy information, and the WE will not be held liable for any adverse reaction resulting from the soap’s use.
All of the products are intended to be consumed within the expiry period indicated.
Rules for Delivery
a) Delivery will be made as per the delivery either on the billing or shipping form. If recipient doesn’t accept the delivery, we shall consider the order to be delivered.
b) BluAqua will be able to attempt delivery of your order only ONCE. In the event the delivery is not executed during the attempt, the customer shall still be charged for the order and has to pay for redelivery where deemed possible.
We will consider the order executed in the below cases:
a) Wrong shipping/delivery address.
b) Recipient not available.
c) Premises locked.
d) Wrong Mobile number or Extension number which may render us unable to reach the recipient for the delivery.
e) Recipient refusing to accept the delivery.
f) Delivered the product at the Gate/ Reception/ Neighbour.
Delivery
The delivery will be done in a safe and proper manner. Once the soap has been delivered to the client and the change of hands has been accomplished with the product in good condition, the customer is responsible for storing and caring for the soap according to our instructions. We are not responsible for any damages that may occur to the soap as a result of this exchange.
Both parties will agree on a delivery day and time, and if the customer is not present at this time and date, and we are unable to contact the customer, the product will be returned to our facilities, and it will be the customer’s obligation to collect the product or rearrange delivery.
Soaps Delivery
The soap arrangements cannot be guaranteed to be exact replicas of the ones shown on site because of different supplies and different seasons constraints. Although the quantity of product will be the same. If there have to be substitutions because of non-availability of products these substitutions will be of equal or higher quality. Change of color of soaps due to non-availability shall also considered under this condition. Also, the soap variety and type may vary from the image depending upon local availability.
Money Gift Delivery
Money gifts refer to the transfer of cash gifts to recipients facilitated through Bluaqua products. These gifts can only be sent and received by individuals aged 18 years and older. A 5% commission fee is applied to all money gifts to cover handling, taxation, and arrangement services. Recipients will be notified of the money gift and will receive the net amount after the deduction of the commission fee. The recipient can use the received funds to make purchases on the Bluaqua products website or through any of our live chat platforms. Money gifts are non-refundable once the transaction is complete; however, if a money gift transaction is cancelled before completion, any applicable refunds will be processed minus the commission fee. Bluaqua products is committed to preventing money laundering and ensuring all transactions are lawful. We reserve the right to request additional information or documentation from the sender or recipient to verify the legitimacy of the transaction. Any suspicious activity will be reported to the relevant authorities in accordance with Kenyan law.
Wedding or festival product Delivery
Please note that; when delivering to a wedding or event venue, we will contact the venue in advance to arrange a mutually convenient time for delivery. If we set up the wedding soap, we shall take a photograph of the soap before leaving and, where possible, obtain a signature from the venue confirming the soap has been received in good condition. Should the venue need to set up the soap themselves we shall explain how the soap is to be displayed and where possible, obtain a signature to verify we have done so. Once the soap has been delivered, we are unable to accept any liability for any damage sustained to the soap thereafter nor any failure to follow the instructions provided.
Delivery Timings
For all same day orders, orders have to be made before 4 pm to guarantee delivery. After then, all orders will be evaluated and if impossible we will deliver on the next day.
We cannot promise delivery late in the evening or very early in the morning; our standard delivery hours are 8:00 a.m. to 6:00 p.m. Clients can request certain delivery times in the Special Instructions section.
When harsh weather conditions, riots, strikes, elections, and peak hour days such as Valentine’s Day, Mother’s Day, Christmas, and New Year’s Eve occur, delivery times cannot be guaranteed.
Address Change
Any changes to the recipient address would be entertained free of cost if they are requested before 24hrs of the actual delivery. After then, changes will be accepted at a convenience charge.
Order Changes
Changes to order information are permissible as long as they are made within a reasonable time frame. If requested 24 hours prior to the actual delivery date and time, order alterations will be accommodated with monetary adjustments. It should be noted that order adjustments are only permitted for equal substitutes or higher-value products, since no money will be reimbursed. Address Changes to the recipient’s location are permissible, however they may incur additional costs depending on the delivery location.
Order Charges
A service charge for delivery to the house or workplace is calculated based on the area and distance from Nairobi’s central business district that is calculated with a flat rate. Before you place an order, you’ll see the delivery costs on the checkout page. That is Within Nairobi CBD, Nairobi and its Surrounding Areas, and Other Towns in Kenya.
Substitution Policy for Soaps
Occasionally, due to temporary regional unavailability, soap or container substitutes are required. If this is the case with the gift you’ve chosen, our skilled florists will make every effort to maintain the style, theme, and color scheme of your arrangement, substituting only items of equal or greater value. In the event that the selected product is not available, we retain the right to substitute soaps (including specified color) or other products of equal or greater value.
Damaged Deliveries
If a third party will be collecting the soap on the customer’s behalf, a release form is to be signed by that person, stating the soap is received in good condition at the time of pickup/delivery. Any reports of damaged products/soaps will be addressed on the same day of delivery, i.e. within 24 hours of delivery. The problem report must be accompanied by solid proof of the product’s damage.
The Customer is liable for any damage, accident, or mishap that may occur once the soap is released from the care and custody of the Supplier’s. The Supplier is not liable for any damage that may occur thereafter.
Payment Options
The website BluAqua.co.ke will execute all transactions in Kenya. The Kenyan Shilling serves as the currency’s foundation. Payments received in other currencies will be converted to Kenyan Shilling for billing and decision making. Payments transactions are handled by a third-party company, which has its own set of terms and conditions on engagement, exchange rate and waiting time. We can accept Visa, Papal, MasterCard, American Express, as well as Mpesa payment.
